Lathrop agrees with Howard on the building's design. He would like to see a patio/pedestrian area <br />included at the front of the store, away from vehicular traffic. <br /> <br />Keany addressed Linda Lowe regarding her opposition to Sam's Club locating in Louisville. He <br />stated that the land in the area Sam's Club is proposing to develop is zoned as cormnercial; therefore, <br />under use-by-right, only commercial development can locate in this area. Keany questioned whether <br />the lighting proposed exceeds the wattage limits stated in the DDSG, and whether Sam's Club tums <br />their lights off after hours. <br /> <br />Diesendorf stated the lights would be off after hours. <br /> <br />Keany expressed concem for local liquor businesses if Sam's Club chooses to lease space to a liquor <br />retailer. <br /> <br />Diesendorf stated they have not found such arrangements to be profitable. <br /> <br />Sisk expressed disapproval of the proposal due to its deficient landscaping requirements, in addition <br />an agreement to provide monetary contributions that assist the applicant. He requested that Sam's <br />Club not allow late night delivery trucks to use Dahlia Street. He agreed with Lathrop on a pedestrian <br />area. Sisk asked that Sam's Club make a commitment to contribute to and become part of the <br />community, outside of generating sales tax revenue. <br /> <br />Diesendorf agreed to look into ways they could contribute to the community. <br /> <br />Davidson explained that, as a statutory City, Louisville's authority is specifically granted by the State <br />Legislature. This authority does not include the ability to choose which stores and businesses can or <br />cannot come into Louisville. Decisions must be based on zoning and standards such as the <br />Commercial Design Guidelines. <br /> <br />Sisk stated he felt that the sales tax agreement between the City and Sam's Club was to allow Sam's <br />Club to exceed Louisville's design standards. <br /> <br />Mayer agreed with Sisk. <br /> <br />Howard moved that Council forward the Final PUD Development Plan Sam's Club - Parcel O, <br />Centennial Valley Filing No. 4 to Planning Commission with Council comments, seconded by <br />Mayer. All in favor. <br /> <br />Lathrop requested Council consider Agenda Item I - RECONSIDERATION OF COLONY <br />SQUARE, ORDINANCE NO. 1279, SERIES 1998 at this time. <br /> <br />Davidson asked if there were any Council objections to considering Agenda Item I at this time. <br /> <br />6 <br /> <br /> <br />
