Davidson stated that the applicant has not provided a letter of credit or an agreement to resolve the <br />drainage issue in spite of the time and extensions allowed. He fears the City will agree to a land <br />exchange but will not receive a correction to the drainage issue in return. <br /> <br />Mayer stated that Council should remain consistent with the previous practice of not passing an <br />Ordinance until all the issues are resolved. <br /> <br />Sisk moved that Council disapprove and deny Ordinance No. 1279, Series 1998 - An Ordinance <br />Authorizing the Sale and Conveyance of a Parcel of Land Owned by the City of Louisville, seconded <br />by Levihn. Roll call was taken. Motion passed by a 7-0 vote. <br /> <br />RESOLUTION No. 23, SERIES 1998 - FINAL PUD DEVELOPMENT PLAN - LOT 11, <br /> BLOCK 2, CTC, 465 SOUTH PIERCE AVENUE <br /> <br />Davidson called for staff introduction. <br /> <br />Ken Johnstone, Acting Planning Director, stated this application is for a Final PUD for a 12,000 sf <br />building on the west side of South Pierce in the CTC. JE & S Video is proposing to occupy the <br />eastern half of the building with the balance available for lease in two tenant spaces. Most of the <br />Planning Commission conditions have been met with this revised submittal. The site plan is fairly <br />typical for smaller buildings in the CTC. Applicable building and parking setbacks have been met. <br />Two curb cuts are proposed onto South Pierce. For a lot this size, staff typically discourages two curb <br />cuts, though it does not introduce any conflicts in this location. Parking is provided at a ratio of 2.6 <br />spaces per 1,000 sf. Bike parking and employee break areas have been identified on the site. <br />Landscaped coverage is proposed at approximately 35 percent, exceeding the 25 percent minimum. <br />The building is proposed to be constructed generally of site cast concrete panels with horizontal and <br />vertical reveals. The Planning Commission approved the application with fifteen conditions, nine <br />of which have been met. The applicant has agreed to comply with all outstanding conditions. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Joseph Ginther, 1539 Pearl Street, Suite 240, Boulder, Colorado, the architect for the project, gave <br />a brief presentation on the landscaping, provided material color samples and was available to answer <br />any questions. <br /> <br />Davidson called for Council questions and comments. <br /> <br />Howard asked for the applicant's plans to address the four Planning Commission conditions. <br /> <br />Ginther replied all four conditions have been met in the proposal before Council tonight. <br /> <br />Lathrop asked that the PUD include a location map. <br /> <br />5 <br /> <br /> <br />
