<br />MAINTENANCE CONTRACT: <br />TRAFFIC CONTROL DEVICES <br />City of LouisvilleIR-4 (MAA) <br /> <br />02 HA4 00062 <br /> <br />CONTRACT <br /> <br />THIS CONTRACT, made this ] l-tb day of --=r-~ 'r ' 20a J- , by and between <br />the State of Colorado for the use and benefit of THE STATE DEPARTMENT OF <br />TRANSPORTATION, hereinafter referred to as the State, and the CITY OF LOUISVILLE, <br />STATE OF COLORADO, 749 Main Street, Louisville, Colorado 80027, FEIN: 846000689 B, <br />hereinafter referred to as the Contractor, <br /> <br />FACTUAL RECITAL <br /> <br />1. Authority exists in the law and funds have been budgeted, appropriated and otherwise <br />made available and a sufficient unencumbered balance thereof remains available for payment in <br />Fund 400, Org. 4530, Approp. 010, Prog. 3000, Func. 2000, Obj 5410, IN, Rept. Category 4500, <br />(Encumbrance Amount: $3,000.00); and <br />2. Required approval, clearance and coordination has been accomplished from and with <br />appropriate agencies; and <br />3. This contract is executed under authority of Sections 29-1-203, 43-1-106, 43-2-102, <br />43-2-103,43-2-135 and 43-2-144, C.RS., as amended, and if an applicable ordinance or <br />resolution has been duly passed and adopted by the Contractor providing authority to the <br />Contractor to enter into this contract, it shall be marked Exhibit "A" and attached hereto and <br />made a part hereof; and <br />4. Section 43-2-135(1)(i) C.RS., as amended, requires the State to install, operate, maintain <br />and control, at State expense, all traffic control devices on the state highway system within cities <br />and incorporated towns; and <br />5. The State does not have the necessary equipment and manpower to operate and maintain <br />all traffic control devices on all state highways; and <br />6. The Contractor has adequate facilities to operate and maintain traffic control devices on <br />certain state highways within its jurisdiction; and <br /> <br />1 <br />
