Agreement Between pEcrElivl <br />Coal Creek Ranch Master Association, Inc <br />AND 1111 Novo 1 zo <br />Todd and Calla Lovrien PLANNING <br />Be it resolved the following is an agreement between the Coal Creek Ranch Master <br />Association, Inc. (herein referred to as the "HOA") and Todd and Calla Lovrien and any <br />successor owner/s of said property (herein referred to as the "applicant") enacted pursuant to <br />the Proposed Annexation by the City of Louisville of a certain parcel of property <br />(approximately 1.156 acres) as described in City of Louisville Ordinance No. 1362, Series <br />2001. This parcel of property is being purchased by the applicant from the current owners, <br />James A. Maurer and Kaylyn Reischick Maurer contingent on annexation by the City of <br />Louisville. <br />1) This agreement shall be effective simultaneously with the adoption by the City of Louisville <br />of Resolution No. 18, Series 2001. Should the Resolution not be adopted this agreement is <br />null and void. <br />2) The applicant does hereby agree to pay all costs and/or expenses related to the inclusion of <br />the annexation of the subject 1.156 acres into the HOA. This includes but is not limited to the <br />following items: <br />a) Legal cost to draw up a Supplemental Declaration and update Property Drawings as may <br />be necessary. The Supplemental Declaration shall include the conditions set forth by the Coal <br />Creek Ranch Declaration of Covenants Conditions and Restrictions, Section 3.3 and <br />subparagraphs (a) through (j) excluding paragraph (b) which is no longer applicable. <br />b) Stipulate in this Declaration that the requirements of the zoning classification "SF-E" shall <br />take precedence over the setback and height restrictions established in the Architectural <br />Guidelines which are part of the Declaration of Covenants Conditions and Restrictions <br />(CC&Rs) of Coal Creek Ranch. <br />c) Recording the Supplemental Declaration and any Updated drawings. <br />d) Prepare a legal description of the portion of Outlot E which the applicant shall be <br />responsible to maintain as more fully described in paragraph (3) below. <br />e) Documents prepared in accordance with this paragraph shall be submitted to the HOA for <br />review and approval prior to being recorded. The cost of the review of a professionally <br />prepared document is not to exceed $350 which is to be paid by the applicant. <br />3) In addition to the approximate 1.156 acres as described in City of Louisville Resolution 18, <br />Series 2110, the applicant agrees to maintain the portion of Outlot E described as follows in <br />subparagraph (a). (For a full description of Outlot E refer to Page 3 of Coal Creek Ranch, <br />Filing 4, Final Plat. Copies of this drawing are available at the City of Louisville Planning <br />Department and the Boulder County Clerk's Office.) <br />a) Boundary Description of Portion of Outlot E to be Maintained by Applicant: <br />Bounded on the North - by the existing Bike Trail. <br />Bounded on the South - by the existing Outlot E/Maurer property line. <br />Bounded on the West - by extending the westerly property line northward to intersect with <br />the Bike Trail. <br />Bounded on the East - by extending a line originating at St. Andrews Lane southward and <br />parallel to the Westerly Maurer property line, intersecting with the existing Outlot E/Maurer <br />property line. The St. Andrews Lane point of origin shall be located twenty-five feet east of <br />the yet to be built driveway which will access the 1.156 acre parcel. <br />
