RESOLUTION NO. 48 <br />SERIES 2002 <br /> <br />A RESOLUTION APPROVING A SPECIAL REVIEW USE <br />FOR "IN BALANCE FITNESS" AT <br />305 McCASLIN BOULEVARD, <br /> LOT 10A, CENTURY OFFICE PARK <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, an application <br />for approval of a special review use for a 2,000 SF women's health and fitness facility (In <br />Balance Fitness); and <br /> <br /> WHEREAS, all materials related to the special review use have been reviewed by City <br />Staff and the Planning Commission and found, with three conditions, to be in compliance with <br />previous approvals and Chapter 17 of the Louisville Municipal Code, including the special <br />review use criteria from 17.40.100.A; and <br /> <br /> WHEREAS, after a duly noticed public hearing concerning said special review use on <br />December 10, 2002, where evidence and testimony were entered into the public record, <br />including the Staff Report dated December 10, 2002, the Planning Commission recommended <br />approval to the City Council, with three conditions; and <br /> <br /> WHEREAS, City Council has reviewed the application and the recommendation of the <br />Planning Commission and City Council further finds that the application should be approved, <br />with the following three conditions: <br /> <br />The occupancy of the building will be subject to review and approval by the Chief Building <br />Official. Approval of the SRU, if granted by City Council, should not be construed as a <br />waiver of any building code requirements. This shall be noted on the SRU plan. <br /> <br />If the applicant wishes to have class sizes in excess of 25 students during the weekday <br />hours of 8:00 a.m. to 5:00 p.m., they shall submit a detailed parking management plan, <br />which may include signage or other means of managing patrons' parking, subject to staff <br />review and approval. In the event the details of the parking management plan cannot be <br />agreed upon administratively, staff reserves the right to require the parking management <br />plan be reviewed through a public hearing special review use process. This shall be noted <br />on the SRU plan. <br /> <br />A general description of the business, consistent with what is represented in the application <br />materials shall be added onto the SRU plan. <br /> <br /> <br />
