RESOLUTION NO. 40 SERIES 2002 A RESOLUTION APPROVING AN AMENDED FINAL PUD DEVELOPMENT PLAN TO AUTHORIZE MCDONALD'S TO CONSTRUCT A "SIDE-BY-SIDE" (SECOND) DRIVE-THRU MENU BOARD AND DRIVE-THRU LANE ON LOT 4, CENTENNIAL VALLEY PARCEL O, AT THE EXISTING MCDONALD'S RESTAURANT WHEREAS, there has been submitted to the Louisville City Council an application to review a PUD amendment to allow for the construction of a "side-by-side" (second) drive-thru menu board and drive-thru lane on Lot 4, Centennial Valley Parcel O, McDonald's, 939 Dillon Road, Louisville; and WHEREAS, all materials related to the amended final PUD development plan have been reviewed by City Staff and the Planning Commission and found, with two conditions that have been met in the final plans submitted, to comply with the applicable provisions of the Louisville zoning regulations and to substantially comply with the Commercial Development Design Standards; and WHEREAS, after a duly noticed public hearing concerning said amended final PUD development plan on 12 November, 2002, where evidence and testimony were entered into the public record, including the Staff Report dated 12 November, 2002, the Planning Commission recommended approval to the City Council with two conditions; and WHEREAS, City Council has reviewed the application and finds that the Planning Commission recommended conditions have been addressed in the plans and further finds that said Amendment to a Final PUD Development Plan should be approved, with the following conditions: The property owner shall be responsible for maintaining all landscaping in a living and healthy condition, and a note to this effect shall be added to the Final PUD. The properly owner shall replace all dead and dying landscape materials at a time recommended by the City. .' The PUD landscape plan shall be modified to reflect the utilization of an approved drought tolerant seed mix for the newly created landscape areas, if practical as determined by staff. NOW THEREFORE, BE IT RESOLVED that the City of Louisville City Council, does hereby approve the PUD amendment allowing for the construction of a "side-by-side" (second) drive-thru menu board and drive-thru lane on Lot 4, Centennial Valley Parcel O, McDonald's, 939 Dillon Road, Louisville. PASSED AND ADOPTED this 19~ day of November, 2002.
