All in favor. Absent: Councilor <br />Muckle. <br /> <br />RESOLUTION No.6, SERIES 2010 - A RESOLUTION APPROVING A <br />REQUEST FOR A SPECIAL REVIEW USE (SRU) TO ERECT, AND <br />OPERATE A BUILDING MOUNTED, CMRS TELECOMMUNICATIONS <br />FACILlTY.AT 315 SOUTH BOULDER ROAD <br /> <br />Mayor Sisk recused himself from the discussion and vote on Resolution No.6, <br />Series 2010 and disclosed he has performed legal work for the applicant Mr. <br />Jim Fetterman. Mayor Sisk left the room. <br /> <br />Mayor Pro Tem Marsella requested a Staff presentation. <br /> <br />Principal Planner Sean McCartney explained the applicant, Clearwire submitted <br />an application to place roof mounted antennas on an existing office building <br />located at 315 South Boulder Road. The Special Review Use (SRU) request is <br />in accordance with Section '17.42 of the Louisville Municipal Code entitled <br />"T elecommunications/CMRS Facilities". <br /> <br />On November 13, 2008, the Planning Commission approved an SRU for AT&T <br />to place nine roof mounted antennas on the same building. These antennae <br />were located on the northeast and southwest facades of the building. If <br />approved, Clearwire will place the proposed antennae on the northwest and <br />southeast corners of the building and screen the roof top mechanical equipment <br />with the same parapet desigln as created by AT&T in their 2008 application. No <br />negative fiscal impact is associated with this request. The development <br />presents a positive fiscal impact by providing telecommunication services <br />without requiring additional municipal services. The Planning Commission <br />forwarded a resolution of support with the condition the Special Review Use is <br />granted to the applicant only. <br /> <br />APPLICANT PRESENTATION <br /> <br />Victor McAlister, 10911 W. 1106th Place, Westminster, CO representing <br />Clearwire, stated he was available to respond to Council's questions. <br /> <br />COUNCIL COMMENTS <br />
