RESOLUTION NO. 30 <br />SERIES 2002 <br /> <br /> A RESOLUTION APPROVING AN <br />AMENDED FINAL PUD DEVELOPMENT PLAN FOR THE CENTURY RETAIL <br />CENTER TO AUTHORIZE ATLANTA BREAD COMPANY INSTALLATION OF <br />WALL SIGN, 321 S. McCASLIN BLVD, LOUISVILLE <br /> <br /> .WHEREAS, there has been submitted to the Louisville City Council, a request <br />for approval of an amended final PUD development plan for a wall sign for the Atlanta <br />Bread Company, 321 S. McCaslin Blvd. Louisville, Lot 1, Century Retail Subdivision; <br />and <br /> <br /> WHEREAS, all materials related to the amended final PUD development plan <br />have been reviewed by City Staff and the Planning Commission and found, with <br />conditions, to generally be in compliance with the sprit and intent of the City's zoning <br />ordinance, including the City Commercial Development Design Standards and <br />Guidelines (CDDSG); and <br /> <br /> WHEREAS, after a duly noticed public hearing concerning said amended final <br />PUD development plan on August 13, 2002, where evidence and testimony were entered <br />into the public record, including the Staff Report dated August 13, 2002, the Planning <br />Commission recommended approval to the City Council, with one condition; and <br /> <br /> WHEREAS, City Council has reviewed the application, including the requested <br />exceptions to certain sign location requirements of the CDDSG and Chapter 17.24 of the <br />Louisville Municipal Code and finds those requests to be justified as documented in the <br />public record for the August 13 Planning Commission public hearing; and further finds <br />that said final PUD development plan should be approved, with the following conditions. <br /> <br />1. Sign to be installed on Wire Mesh Background: 18-inch letter height total, <br /> two lines maximum, 20foot maximum length; <br />2. Sign is approved for this applicant only - the Atlanta Bread Company. If <br /> applicant is no longer occupying the restaurant space it currently occupies, <br /> the entire sign package, wire mesh and any other related sign materials shall <br /> be removed within 10 days of vacancy and the brick wall shall be replaced to <br /> it's original condition. <br />3. A note shall be added to the PUD amendment acknowleddging that the PUD, <br /> as amended, represents the total permissible signage for the PUD, and the <br /> owner shall execute the PUD amendment. <br /> <br /> <br />
