COUNCIL COMMUNICATION <br />TO: MAYOR AND CITY COUNCIL <br />FROM: MALCOLM FLEMING, CITY MANAGER <br />DATE: APRIL 6, 2010 <br />SUBJECT: APPROVAL TO GRANT THE PUBLIC SERVICE COMPANY A UTILITY <br />EASEMENT ON THE ADLER/FINGRU OPEN SPACE PROPERTY <br />ORIGINATING DEPARTMENT: PARKS & RECREATION <br />SUMMARY: <br />The Public Service Company is requesting a utility easement that would cross the jointly owned <br />(50% Boulder County, 25% Louisville and 25% Lafayette) Adler/Fingru Open Space property. <br />This easement would be approximately ten feet wide by 600 feet long. The utility lines would <br />be installed via subsurface boring and cable pulling resulting in no surface damage to the Open <br />Space property. <br />th <br />According to the Public Service Company this project will serve the area bounded by S. 104 <br />Street and HWY 287, and HWY 42 and Dillon Road. Additionally, the utilities will benefit <br />Exempla Hospital, stimulate business growth at the Colorado Tech Center and relieve <br />overloaded feeders resulting in reduced outage times and increased service reliability. <br />The Open Space Advisory Board has reviewed this request and recommends approving the <br />easement. The Open Space Advisory Board has also reviewed the Utility Easement language <br />and has had the opportunity to contribute language to the Ecological, Hydrological and <br />Geological Considerations Section of the document. <br />FISCAL IMPACT: <br />The Public Service Company has agreed to pay the landowners $10,000 for the permanent <br />easement. Louisville, as a 25% stakeholder in the property, will receive $2,500. <br />RECOMMENDATION: <br />Approve the request <br />ATTAHMENT(S): <br />1. Proposed Utility Easement Contract <br />2.
