Davidson called for Council questions and comments. <br /> <br />Howard requested a construction schedule from the applicant to determine whether the deadline in <br />condition #3 would be a hardship and, if so, what deadline would not be. <br /> <br />Hartronft replied that no definite construction schedule has been set. The construction schedule will <br />be set after project approval is received and the owner has time to negotiate tenancies, etc. <br /> <br />Howard stated that parking requirements for this building would be approximately 49 spaces and <br />asked Wood if that number of spaces are currently open on a continuous basis. <br /> <br />Wood replied, yes. <br /> <br />Howard inquired approximately how many spaces would remain after those 49 are absorbed by the <br />applicant. <br /> <br />Wood replied he did not know. <br /> <br />Howard did not agree with the applicant's claim that condition #1 requiring the signage to be subject <br />to later review and approval would be a hardship. He explained that it is required of everyone, unless <br />they have a sign package to present for approval as part of their PUD. <br /> <br />Howard asked Wood whether there is a density of potential applications to reasonably expect their <br />participation in a future parking solution. <br /> <br />Wood replied, no. <br /> <br />Lathrop commended Hartronft on the design of the building. He then asked Light whether or not <br />Council could hold up further growth downtown until the CDDSG and parking plan are approved. <br /> <br />Light replied that with regard to the application now before Council, it would be a difficult legal <br />argument to make to say you could now deny the project solely on the basis of an anticipated future <br />set of guidelines. <br /> <br />Lathrop then asked Light whether Council could require 42 parking spaces. <br /> <br />Light replied that before the commercial guidelines were adopted, there was and still is on the City's <br />books, an Ordinance that states uses within the central business district are exempt from off-street <br />parking requirements. The City then adopted the commercial guidelines, which apply to any property <br />being developed as a PUD in a commercial district, including this property. There is no express <br />exemption in those guidelines for off-street parking requirements. On its face, the commercial design <br />guideline applies and does require parking of all commercial projects subject to those guidelines. <br /> <br />13 <br /> <br /> <br />
