Condition #3 <br /> <br />The applicant has agreed to address the screening of the generator, <br />and a letter of credit is in place. They request that it not be a condition <br />on this application. <br /> <br />Condition #4 <br /> <br />The applicant requests that they not have to install a drip irrigation <br />system for the free-standing landscape containers. <br /> <br />Conditions #5/6 <br /> <br />The applicant requests that they not have to submit an amendment to <br />the overall Final PUD and suggest an alternative means of recording <br />notice of remaining development area. <br /> <br />The remaining conditions have been met or agreed to. The applicant has also made one new request, <br />to illuminate the campus identification sign at the southeast comer of the site with ground-mounted <br />direct lighting. In further consideration of this proposed new overall project identification sign, <br />including the lighting, staff believes it is not appropriate to include that request in this application. <br />This application has been advertised as simply a Final PUD for Lot 3 and a replat of Lots 3 and 4. <br />The sign relates to the overall Final PUD and, as such, should be included in an amendment to the <br />overall Final PUD. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />William Feinberg, 303 E 17th Avenue, Suite 920, Denver, Colorado, stated that the Resolution was <br />presented to Council on July 21 with three conditions. At that meeting, three additional conditions <br />were added by Council, bringing the total to six. He provided a brief history of the development as <br />background for the request that conditions number three, four, five and six not be included on this <br />application. He stated that they would agree to meet those conditions, but would ask that they not <br />be part of this PUD as the lots have different owners. <br /> <br />Davidson agreed with the applicant's request to record the landscaping requirement against the deed <br />versus amending the PUD, and suggested replacing conditions number five and six with this <br />requirement. <br /> <br />Keany expressed concern that hand-watering of the potted landscape materials would not occur on <br />a regular basis. He stated that since these plants are part of the landscaping plan presented for this <br />property and are being included in the landscaping credit, they should be maintained at the same <br />level as any other landscaped area. <br /> <br />Feinberg explained that the potted materials are shown on the landscape plan, however, they are not <br />included in the landscaping credit. He did understand Keany's concern for the potted materials due <br />to Colorado's dry climate and stated that he would comply with any Council conditions on the <br />Resolution regarding the potted materialsl <br /> <br /> <br />
