<br />These comments are submitted with the understanding that, per the Conoco Phillips <br />letter from Wayne McCreesh to Malcolm Fleming dated Feb. 25, 2010, Conoco <br />Phillips is committed to fulfilling their obligation to provide the full value of acreage <br />required of the 12% land dedication. OSAB recommends that the public land <br />dedication be free of all liens and encumbrances per the Louisville Municipal Code <br />16.16.060. OSAB is also acutely aware that per section 17.28.110 of the Louisville <br />Municipal Code additional valuable land dedication in excess of the required 12% <br />dedication is required for waivers of height, buffer or other development <br />requirements outlined in the Louisville Municipal Code.
