These comments are submitted with the understanding that, per the Conoco Phillips
letter from Wayne McCreesh to Malcolm Fleming dated Feb. 25, 2010, Conoco
Phillips is committed to fulfilling their obligation to provide the full value of acreage
required of the 12% land dedication. OSAB recommends that the public land
dedication be free of all liens and encumbrances per the Louisville Municipal Code
16.16.060. OSAB is also acutely aware that per section 17.28.110 of the Louisville
Municipal Code additional valuable land dedication in excess of the required 12%
dedication is required for waivers of height, buffer or other development
requirements outlined in the Louisville Municipal Code. OSAB requests that Council
communicate with OSAB the results of any deliberations or decisions that may affect
the acreage and/or development of public land dedications associated with
development of the Conoco Phillips property.

For your deliberations, I and other members of the Open Space Advisory Board are
willing to appear before Council to represent the opinions of the Board expressed in
this letter and to advise Council on topics related to the development of the Conoco
Phillips property.

Respectfully,

Tom Davinroy
Chair, Louisville Open Space Advisory Board

Cc: Malcolm Fleming, City Manager, City of Louisville
Joe Stevens, Director of Parks and Open Space, City of Louisville
Sean McCartney, Principal Planner, City of Louisville
