<br />Section 4. The repeal or modification of any provision of the Municipal Code of the <br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole <br />or in part any penalty, forfeiture, or Jliability, either civil or criminal, which shall have been incurred <br />under such provision, and each provision shall be treated and held as still remaining in force for the <br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br />judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, <br />proceedings, or prosecutions. <br /> <br />Section 5. All other ordinances or portions thereof inconsistent or conflicting with this <br />ordinance or any portions hereof are hereby repealed to the extent of such inconsistency or conflict. <br /> <br />Section 6. The City Council herewith finds, determines and declares that this <br />ordinance is genuinely and urgently necessary for the immediate preservation of the public <br />health, safety and welfare because existing regulations remain inadequate to address potential <br />impacts of medical marijuana dispensaries on the health, safety, and welfare of the community <br />and, as such, the City's current moratorium should be continued uninterrupted for a reasonable <br />additional period of time. The City Council also herewith finds that the recent proliferation of <br />medical marijuana dispensaries around the State, the recent inquiries the City has received <br />regarding the operation of medical marijuana dispensaries within the City, the fact that anticipated <br />but not yet enacted legislation firom the Colorado Legislature may impact how such dispensaries <br />may be regulated, the fact that such legislation may not be effective prior to the current moratorium <br />expiration date, and the fact that additional time will be needed to analyze the anticipated state <br />legislation which has not yet been enacted, constitute an emergency which could not have been <br />reasonably anticipated or foreseen and on which immediate action is genuinely and urgently <br />necessary for the preservation of public, health, safety, and welfare.
