RESOLUTION NO. 47 <br /> SERIES 2001 <br /> <br />A RESOLUTION APPROVING AND RATIFYING THE RELEASE OF <br />CERTAIN CONSERVATION EASEMENTS AND AGREEMENTS IN <br />CONNECTION WITH THE RE-ALIGNMENT OF THE NORTHWEST <br />PARKWAY <br /> <br /> WHEREAS, the City of Louisville, City of Lafayette, City of Broomfield and County of <br />Boulder are parties to an Intergovernmental Agreement dated February 18, 1999, as amended by an <br />Amendment among such parties and the Northwest Parkway Public Highway Authority ("PHA") <br />dated January 16, 2001 (the "Northwest Parkway IGA"); and <br /> <br /> WHEREAS, the City of Louisville and the County of Boulder are parties to an <br />Intergovernmental Agreement dated June 17, 1999, as amended by Amendment approved by <br />Ordinance No. 1364, Series 2001 (the "City/County IGA"); and <br /> <br /> WHEREAS, pursuant to the Northwest Parkway IGA and the City/County IGA, there was <br />established the original alignment of the Northwest Parkway and a new alignment of the Northwest <br />Parkway over certain portions of the Trillium, Boulder County Land Venture, and Glacier Park <br />open space properties located at the northeast, southwest, and southeast comers of the intersection <br />of Dillon Road and South 104th Street, and over certain other lands outside the City of <br />Louisville; and <br /> <br /> WHEREAS, the closing on the transactions for the realignment of the Northwest <br />Parkway has recently occurred, resulting in the release of PHA bond proceeds for open space <br />acquisitions; and <br /> <br /> WHEREAS, pursuant to and as part of such transactions, and at the request of the <br />County and PHA, there has been provided to the PHA partial releases of certain conservation <br />easements and agreements encumbering lands to be included within the new alignment of the <br />Northwest Parkway; and <br /> <br /> WHEREAS, City Council by this Resolution desires to approve such releases and ratify <br />certain actions taken in connection therewith. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The City Council hereby approves of and ratifies the execution and delivery to the <br />PHA of those certain Partial Releases of Conservation Easements, Annexation and Zoning <br />Agreement, and Agreement which are in the forms attached hereto and incorporated herein by this <br /> <br /> <br />
