PARTIAL RELEASE OF CONSERVATION EASEMENT <br /> <br /> THIS PARTIAL RELEASE OF CONSERVATION EASEMENT is made effective this day of <br /> , 2001 by the City of Louisville, a Colorado municipal corporation whose address is 749 Main Street, <br />Louisville, Colorado 80027 (the "City"), unto and in favor of the Northwest Parkway Pubhc Highway Authority, a <br />body politic and corporate under the laws of the State of Colorado, whose address is 555 Eldorado Boulevard, Suite <br />130, Broomfield, CO 80021 (the "Authority"). <br /> <br /> WHEREAS by a Conservation Easement granted by the County of Boulder (the "County") to the City <br />dated March 17, 1994 (the "Easement") and recorded in the records of Boulder County at Reception No. 1412542, <br />the County conveyed to the City a conservation easement in perpetuity, subject to the terms and provisions of the <br />INTERGOVERNMENTAL AGREEMENT Northwest Parkway (Boulder County Area) Comprehensive <br />Development Plan (Revised April 29, 1991), recorded in the records of Boulder County at Reception No. 1105202 <br />(the "INTERGOVERNMENTAL AGREEMENT") over lands described in the Easement; and <br /> <br /> WHEREAS, the City desires to partially release the Easement as to parcels of land owned or to be acquired <br />by the Authority. <br /> <br /> NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby <br />acknowledged, the City hereby does remise and release unto the present owner or owners of the real property <br />described in Exhibit A, attached hereto and incorporated herein by reference, and unto the heirs, successors and <br />assigns of such owner or owners forever, all the right, title and interest which the City has under and by virtue of the <br />Easement in that portion of the real property described in Exhibit A.
