Mayer asked the applicant their reason for requesting a 67' maximum building height in the high <br />density zone. <br /> <br />Moore replied that this was to provide flexibility. The demand for out-patient services has increased <br />and some of the equipment and material used to perform these services is considered hazardous <br />material. These uses require a greater separation and they can meet that need with this flexibility. <br /> <br />Mayer commended the applicant for working with the City and the neighbors on this project. <br /> <br />Lathrop asked Wood whether it is clearly delineated that the building height limitations would <br />include mechanical. <br /> <br />Wood replied it would be best to clarify that. <br /> <br />Lathrop asked why the road to the cemetery is not shown on these documents. <br /> <br />Moore replied that the topography is not shown as this document is for planning purposes. They plan <br />to improve and pave the cemetery road and provide access at all times. <br /> <br />Mayer moved that Council approve Ordinance No. 1284, Series 1998, An Ordinance Amending Title <br />17 of the Louisville Municipal Code, Entitled "Zoning," by Rezoning As Planned Community Zone <br />District Commercial (PCZD-C) Approximately 61 Acres of Land Designated as Lots 1, 2, 4, and 7, <br />and Adjoining Rights-of-Way, Health Park Subdivision, Filing No. 5, with the following <br />amendments: <br /> <br /> 1. There is a 200 foot setback from US 36. <br /> 2. There is a 200 foot setback for third-stories from the north property line. <br /> 3. The 67' building height restriction in the high-density zone includes <br /> mechanical. <br /> 4. All of the associated uses be contained within buildings and not be free- <br /> standing. <br />Motion was seconded by Levihn. <br /> <br />Howard offered a friendly amendment that all foliage be identified, accepted by Mayer and Levihn. <br /> <br />Keany offered a friendly amendment that dining facilities, financial facilities and church uses are <br />accessory uses and contained within the main buildings, accepted by Mayer and Levihn. <br /> <br />David Smith, Hospital Administrative Director, expressed concern that since the facility is a church- <br />sponsored organization, they might oppose that restriction. He agreed to all the other conditions. <br /> <br />Keany offered an amendment that churches be allowed by special review use, accepted by Levihn. <br /> <br />6 <br /> <br /> <br />
