Balch . <br /> SUBJECT: Adequate user charges • <br /> DATE: March S, 1973 • <br /> • <br /> • <br /> Section 204(b) of the newly adopted Federal Mater Pollution Control Act <br /> states that after March 1, 1973, no grant is to be approved for treatment <br /> facilities unless th3 applicant (A) has adopted or will adopt a system <br /> of charges to assure that each recipient of waste treatment services within <br /> the applicant's jurisdiction, as determined by the administrator, will pay <br /> ' its proportionate share of the costs of operation and maintenance (includ- <br /> i replacement) of any waste treatment services provided by the applicant; <br /> (B) that an additional industrial-user charge is based on the repayment <br /> of a shrr, of the Federal Grant so that the industrial usors are not sub- <br /> sidized with Federal funds; and (C) has legal, institutional, managerial <br /> and financial capability to ensure adequate construction, operation and <br /> maintenance of treatment works throughout the applicant's jurisdiction as <br /> determined by the administrator. <br /> • <br /> Therefore, you should review your users charges and your industrial users <br /> charges to see that they comply with this section of the Federal Act. Since <br /> we consistently keep hearing rumors that the sewage construcion grant <br /> program will be terminated at some unspecified future date, it would be wise <br /> • for all communities and sanitation districts to :view their «wica tharoe <br /> rates (even if you will not request a Federal rant) so that funds will big <br /> available when replacement or enlargement of the facility becomes necessary. <br /> Frank J.
