These plans were accompanied by the requirement that I <br /> sign a letter which, in part, contained a standard statement <br /> to the effect that any work done by Mood Bros. Hares, Inc. <br /> prior to the approval of the Final Plat of said subdivision <br /> would be at our own risk and subject to any changes which <br /> may *Dour as a result of the hearings yet to be held. <br /> However, I am most dimply concerned with the last two <br /> paragraphs of the letter, which was initiated by your City <br /> *nginssr, Mr. Dan White. These paragraphs tended to sound <br /> a warning that the City might be extremely reluctant to <br /> consider coadamnatias of the Hsrpel and Patete lots which <br /> would possibly be necessary before Wood Pros. could accomplish, <br /> the drainage work s000rding to the present plans. <br /> I believe you indicated to am same time ago that the <br /> City would support us in condemnation of these lots if such <br /> became necessary, you and I both realised at that time, of <br /> course, that the authorisation to condemn must cons from City <br /> Council, and I did not interpret your statement as being the <br /> final word on the subject. That is not the problem. The <br /> Problem, as I see it, is that we may rec+ive approval of our <br /> plat subject to completing the drainage work as it is designed <br /> and then be forced to pay an exorbitant price for the two lots <br /> which we will need in order to accomplish said drainage work. <br /> Our position in the matter is -that we are planning to offer <br /> the !torpid* and the Patetes an amount of now perhaps 101 or <br /> 151 in excess of the value that will be reached by our appraiser, <br /> ..f R .
