411 411 <br /> Regular Meeting, Louisville City Council, June 6, 1978 PAGE 6 <br /> ITEMS FROM PEOPLE IN <br /> ATTENDANCE NOT APPEARING There was no one present that wished to <br /> ON THE AGENDA: speak. <br /> CITY ATTORNEY'S REPORT: Attorney Joss read the resolution. Council- <br /> RESOLUTION NO. 17-ADOPTING man Gent DiCarlo moved that Resolution No. 17, <br /> PEP,SCYNEL CODE Series 1978 be adapted. Seconded by Council- <br /> man Mary DiLorenzo. Question called for. <br /> 4 ayes. Opposed none. Motion carried. <br /> RESOLUTION No. 18 Attorney Joss read the resolution in its <br /> CITY DOCUMENTS entirety. Councilman Meier moved that <br /> Resolution #18, Series 1978 be adopted. <br /> Seconded by Councilman DiCarlo. Question <br /> called for. 4 ayes - opposed none. <br /> Motion carried. <br /> RESOLUTION No. 19 Attorney Joss explained to Council the pro- <br /> INITIATING ANNEXATION ceeding for this anticipated annexation <br /> PROCEDURES FOR PROPERTY was unique since 1007 of the property owners <br /> OWNED BY DANAILOFF, KING, were not involved. There was a small tract <br /> FOSTER, ERBERS & SANTILLX of land, less than one acre, that divides <br /> the EBERS property from the FOSTER property. <br /> He had researched the records at Boulder <br /> County and to this time was unable to find <br /> wbo owned this small tract, even the Title <br /> Company's were uncertain. State Statutes <br /> allow the City to annex the total parcel of <br /> property, but the procedure is different <br /> from other annexations. The resolution pro- <br /> poses our intention to annex this property <br /> and a public hearing be set, publication <br /> notices are different. At the Public Hearing, <br /> Council has to review whether or not the <br /> property is eligible for annexation. This <br /> resolution only indicates that the City <br /> formally accepted the petition to annex the <br /> particular parcel in question and set forth <br /> publicly that Council is willing to proceed <br /> with the necessary hearings and statuatory <br /> procedures to consider the annexation. <br /> Attorney Joss read Resolution X19, Series 1978 <br /> in its entirety. Councilman DiCarlo moved <br /> that Resolution No. 19, Series 1978 be adopted <br /> and a Public Hearing be set for July 6, 1978. <br /> Seconded by Councilman Meier. Question called <br /> for. 4 ayes - none opposed. Motion carried. <br />
