Question
called for. 3 Ayes, Councilman DiCarlo, No.
Motion carried.
COLORADO AND SOUTHERN Administrator Wuri informed Council the
RAILWAY ANNEXATION REQUEST request for annexation was for land adjacent
to CTC, and brought attention to a letter
from Don Houlehan and a map depicting the
area. Mr. Larry Mizel, Don Houlehan, and
Joe Howard were in attendance. Mr. Houlehan
of the law firm DeMuth, Eiberger, Kemp and
Backus, stated he represented the C&S RR.
The reason for the request at this time was
that an agreement had been reached and pre-
liminary costs had been worked out with
respect to bringing water and sewer lines
into the Colorado Technological Center up
to Dillon Road. They are being fully planned
and installed and costs will be shared by
the property owners within the CTC area and
the railroad; therefore C&S is anxious to
get the annexation of its property completed
before the utility lines are installed to
serve the entire area. Mayor Waschak asked
how soon the railroad anticipated laying
the utility lines? Mr. Houlehan replied
August 17, 1978 if everything goes according
to schedule.
Ur. Larry Mizel, of CTC; at the completion
of annexation and zoning, working plans
will be started and as soon as the working
plans can be developed and bids are out, they
plan to physically go forward with the
utility lines to Dillon Road and the inter-
section of the railroad. Delay over the
past 18 months was caused by the railroad
wanting to complete the annexation and zoning
of all their land before advancing funds
necessary to complete the utilities. This
expenditure amounts to approximately $400,000.
Mr. Mizel stated they do have a written
commitment from the railroad for this ex-
penditure subject to the annexation.
