It Landlord shall sell the <br /> Center and the land on which it stands, or shall lease the Center and <br /> said land, or shall otherwise assign or dispose of this Lease, Landlord <br /> may assign and turn over the said deposit or any balance thereof to <br /> Landlord's grantee, lessee or assignee, and Tenant hereby releases and <br /> relieves Landlord tram any and all liability for the return of said <br /> deposit and shall look therefor solely to said grantee, lessee or <br /> assignee; it being expressly agreed that this provision shall apply to <br /> each and every sale, conveyance or lease of the Center and said land, <br /> or assignment or disposition of this Lease. <br /> ARTICLE 6. SHORT FORM LEASE <br /> This Lease 3ha11 not be filed for record. If recording of same is <br /> desired by either party, the parties will execute a short form of Lease <br /> for such purpose. <br /> ARTICLE 7. LATE CHARGES <br /> It is further understood and agreed that the Landlord may without in any <br /> way waiving its right to declare a default hereunder make a late charge <br /> which shall be in the amount of ten percent (10%) of any monthly rent <br /> installment, including percentage rent due, which is delinquent thirty <br /> (30) days or more. <br /> ARTICLE 8. ASSOCIATION <br /> It is contemplated that the Tenants in the Center will form a Merchants' <br /> Association and Tenant expresses an intent to join same and to cooperate <br /> therewith in all reasonable things not in conflict• with the provisions <br /> of this Lease, or, in Tenant ' s opinion, detrimental to Tenant's business. <br /> ARTICLE 9. IN UR,Ai:CE EXCESS <br /> The Tenant agrees to pay additional ren: equal to any Increase in <br /> premiums for insurance against loss 'r fire, windstorm, hail or public <br /> liability that may be charged during the term of this Lease on the <br /> amount of insurance carried by the Landlord on said premises.
