<br />ORDINANCE NO. 995 <br /> <br />AN ORDINANCE REPEALING AND REENACTING A PORTION OF <br />ORDINANCE NO. 922 WITH RESPECT TO IMPOSITION OF AN <br />EMERGENCY TELEPHONE CHARGE UPON TELEPHONE EXCHANGE <br />ACCESS FACILITIES WITHIN THE CITY OF LOUISVILLE <br /> <br /> <br />WHEREAS, it was discovered that there is an inconsistency <br />between Ordinance No. 922, passed and adopted on December 16, <br />1986, and that certain Intergovernmental Agreement Concerning the <br />Implementation of an "E9Il" Emergency Telephone Service dated <br />September 22, 1987, to which the City of Louisville is a party; <br />and <br /> <br />WHEREAS, the City Council of the City of Louisville has <br />determined that it is in the City's best interest to correct the <br />conflict as soon as possible. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF LOUISVILLE, <br />COLORADO: <br /> <br />l. Section 2 of Ordinance No. 922, dated December l6, 1986 <br />is hereby repealed in its entirety and reenacted as follows: <br /> <br />Section 2. It is hereby imposed, pursuant to <br />C.R.S. fi29-ll-101, et seq., as amended, (the <br />Act) upon all telephone exchange access <br />facilities within the City of Louisville an <br />emergency telephone charge in an amount not <br />to exceed 2% (two percent) of the tariff <br />rates as approved by Public utilities <br />Commission or $0.50 (fifty cents) per month <br />whichever is less, the proceeds from which <br />shall be collected and administered according <br />to the terms of the Intergovernmental <br />Agreement Concerning the Implementation of a <br />"E9Il" Emergency Telephone Service between <br />the County of Boulder, the City of Boulder, <br />et ale dated September 22, 1987 and the Act, <br />as amended. The City Council further <br />authorizes the Authority Board as described <br />in the Intergovernmental Agreement to set <br />such lesser charges as the Authority Board <br />may from time to time determine are <br />appropriate in the course of the Authority <br />Board's exercise of its functions under the <br />Intergovernmental Agreement. <br />
