ORDINANCE NO. 995 AN ORDINANCE REPEALING AND REENACTING A PORTION OF ORDINANCE NO. 922 WITH RESPECT TO IMPOSITION OF AN EMERGENCY TELEPHONE CHARGE UPON TELEPHONE EXCHANGE ACCESS FACILITIES WITHIN THE CITY OF LOUISVILLE WHEREAS, it was discovered that there is an inconsistency between Ordinance No. 922, passed and adopted on December 16, 1986, and that certain Intergovernmental Agreement Concerning the Implementation of an "E9Il" Emergency Telephone Service dated September 22, 1987, to which the City of Louisville is a party; and WHEREAS, the City Council of the City of Louisville has determined that it is in the City's best interest to correct the conflict as soon as possible. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF LOUISVILLE, COLORADO: l. Section 2 of Ordinance No. 922, dated December l6, 1986 is hereby repealed in its entirety and reenacted as follows: Section 2. It is hereby imposed, pursuant to C.R.S. fi29-ll-101, et seq., as amended, (the Act) upon all telephone exchange access facilities within the City of Louisville an emergency telephone charge in an amount not to exceed 2% (two percent) of the tariff rates as approved by Public utilities Commission or $0.50 (fifty cents) per month whichever is less, the proceeds from which shall be collected and administered according to the terms of the Intergovernmental Agreement Concerning the Implementation of a "E9Il" Emergency Telephone Service between the County of Boulder, the City of Boulder, et ale dated September 22, 1987 and the Act, as amended. The City Council further authorizes the Authority Board as described in the Intergovernmental Agreement to set such lesser charges as the Authority Board may from time to time determine are appropriate in the course of the Authority Board's exercise of its functions under the Intergovernmental Agreement.
