<br />C. A new Article VII is enacted as follows: <br />Section 1. Underqround Electrical Distribution Lines in <br />New Areas. The Company shall place newly constructed <br />electrical distribution lines underground to serve new <br />residential subdivision areas in accordance with the <br />Company's tariffs and City's subdivision regulations; <br />provided, however, that the Company shall not be required <br />to install any such facilities for which the charges <br />provided in its tariffs have not been paid. <br />Section 2. Overhead Conversion at Expense of Company. <br />a. As and when requested by the City, the Company will <br />spend annually an amount equal to one percent (1%) of the <br />preceding calendar year's electric revenues received from <br />customers within the Ci ty_ --to.--move .. electric-- distribution- <br />lines located in streets and other public places within the <br />City underground, provided that the undergrounding shall <br />extend for a minimum distance of one block or 750 feet, <br />whichever is less or as may be agreed to by the parties. <br />b. Any unexpended portion of the one percent (1%) of <br />electric revenue may be carried over to succeeding years <br />and, in addition, upon request by the City, the Company <br />shall anticipate amounts to be available for up to three <br />( 3 ) years in advance. Any amounts advanced shall be <br />credited against amounts to be expended in succeeding years <br />until such advances are eliminated. No relocation expenses <br /> -4- <br />
