Attorney Rauteastraus
read the ordinance on first reading by title
only and the request was for publication-.. :.
PUBLICATION AUTHORIZED Councilman Cussen moved, Councilman Ferrara
seconded that Ordinance #762 - Water Bond
1982 be published.
Councilman Leary Inquired if there was an assumption that the
existing tax assessment is adequate because
the revenue is coming from the tap fees.
Administrator Wurl advised this was a legi-
timate assumption.and was put into the
ordinance to guarantee the bond owners that
revenues ould be available to repay the bond,
by virtu this to enjoy a lower interest
rate.
Dunn Krahl - Boettcher- E. Co. Referred to page 9 of the ordinance "to assure
that the revenue thereby produced, together
with the proceeds of the general ad valorem tax
and any other legally available funds," then
advised this gives Council the right to dimin-
ish the tax levy by the amount of funds that
are on hand.
Councilman Leary Inquired why this was an emergency ordinance.
Emergency Ordinance Mr. Krahl advised because after second read-
ing it provides a better time frame to close,
get the money and get it invested.
Mr. Leary felt that was not why the emergency
clause was put in the State Statutes; that
is was intended for a real emergency, i.e.
a natural disaster. Felt that it has been
abused in the past as a means of cutting out
time periods available for initiative refer-
endum. etc. If this practice could be avoided
he would rather see it done.
