Suitts Water Agreement - Howard McGinn Exchange - Dry Creek Purchase . <br /> Enclosed in the packet is an agreement that we have baen negotia- <br /> ting with Mr. Suitts for quite some time as relates to his Howard <br /> and Dry Creek Water. Their proposal is to trade some of our <br /> McGinn water for his Howard water with some additional cash <br /> plus an outright purchase of his Dry Creek Water. What he would <br /> like to do is take that out in Water Taps which is fine, we <br /> would just simply transfer the amount of money that we would pay <br /> for the waterintoescrow and as the taps are issued, we would transfer <br /> that back into water rights , split it up or proportionate as we <br /> do on the water rights and the balance to other capital projects . <br /> C. Joeckel Sewer Easement - In our agreement with Jacobs-Kahan , the <br /> Homart people we have agreed that in the event they were unable <br /> to obtain easements for various parts of the sewer line extension, <br /> that the City would agree to condemn the R.O.W. Mr. .Joeckel <br /> has indicated that he does not intend to go along with providing <br /> the easements and that if the City wants any easements , they are <br /> going to have to condemn to get them. We have hired an appraiser <br /> to appraise the cost , all of which will be paid by Homart, the <br /> entire cost , that is the cost of the easement , the cost of the <br /> appraisal , attorney's fees and whatever else is involved. So as <br /> I have said, we have hired an appraiser and I'm trying to contact <br /> him now to get a copy of the report to determine the cost. We <br /> would like to have Council' s authority to proceed with the condem- <br /> nation of that portion of the sewer line easement over to Superior. <br /> D. Harper Lake - Engineering Contract Approval - Enclosed in the <br /> packet is a copy of the contract on the engineering for the <br /> completion of the Harper Lake project and I would also say that <br /> in the way of a report that the bill was signed by the Governor <br /> and that the Colorado Water Conservation Board said that they now <br /> have the money to proceed with their part of the Engineering Cost <br /> and that they have asked for a letter from us telling them exactly <br /> what the matching funds will be used for. I would intend <br /> to after Councils approval of the engineering contract , write them <br /> a letter as he has requested. <br /> 11. Council Comments and Committee Reports <br /> 12.
