The Lessor, for end in consideration of the covenants : and agreements hereinafter mentioned, to be kept and performed by M the Lessee, its officers, agents and successors, doss hereby lease unto the Lessee the following described water rights • subject to the terms and conditions herein contained, to-wits A total of 2.0 shares of stock in the Marshall Lake division of the Farmers Reservoir and Irrigation Company, • mutual ditch company, held in the name of Thomas R. turber. 2. said water rights are specifically leased to the Lessee for use in the municipal water system operated by the Lessee. It is understood by the parties that the Lessee will request delivery of water represented by the water rights described above at the headgats on the Community Canal utilised by the Lessee for delivery of other water rights in said company owned or leased by the Lessee. If this Lease is not approved by the board of • Directors of the Farmers Reservoir and Irrigation Company this Agreement shell be void and of no further force or effect and any money paid by Lessee to Lessors hereunder shall be promptly returned to Lessee by Lessor. 3. The term of the Lease shall be from the date first written above through and including December 31, 111S. Lessee shell be entitled to all water presently available to the above shares, including the right to any carryover water on the books of the farmers Reservoir and Irrigation Company. 4.
