• request was moved, seconded and approved
uneniaoualy.
Mayor Meier moved that the Consent Agenda be
approved as amended, Luce seconded, and the motion
was approved unanimously.
(The minutes omitted Sharon Asti-Carenci as being
present at the March 21 , 1983, Council Meeting.
Other corrections should include the spelling of
Joe Prouty's name as it was incorrectly printed as
Proudy. Also, the Vice President of Cybermedic is
William E. Brown, not Lockett .Brown as reported in
the minutes. ) `
PUBLIC COMMENTS None.
ARBOR DAY PROCLAMATION Mayor Meier read the proclamation in its entirety
declaring April 13th - April 20th as Arbor Week
and April 20th as Arbor Day.
RESOLUTION #6 -
OPPOSITION TO H.B. 1360
CREATION OF VESTED
RIGHTS Rautenstraus read Resolution #6, "A Resolution
Opposing the Adoption of House Bill 1360
Concerning the Creation of Vested Property Rights"
in its entirety. Mayor Meier moved that
Resolution #6 be adopted and Luce seconded.
•
Luce spoke in favor of the resolution commenting
that our Representative, Les Fowler, is a crucial
contact and that the Council should formally
present Rep. Fowler with this resolution. "This
bill would impose upon municipalities the
liability in terms of what the City would be
responsible for should its citizens decide to
initiate a zoning issue. It would compromise the
right of initiative."
Leary stated that it not only concerned zoning , it
also states that "any land use regulation" would
r forever be precluded from alteration any land use
regulation applicable to the property which
includes subdivision regulation, site design,
landscaping, slope, soil, sign, drainage
requirements, and set-back and height
restrictions." If this bill were to pass, any
change that the City made from that point on would
not apply to any property that was zoned prior to
the passing of this bill creating totally
different standards applying to different people
over a course of time.
2
