for publication and suggest a Public Hearing be
set for April 15, 1985.
Mayor ?mason moved that Ordinance 6$83 be
published and a Public Searing be set for April
15, 1986. Mohr seconded.
Osyaanski asked if having a First Reading.
publishing the Ordinance and setting a Public
Searing constituted acceptance of the Ordinance
with the stipulations reoommended by the Planning
Commission. Mayor tauson explained that the
conditions would not become part of the Ordinance.
Rautenstraus stated that the annexation agreement
for this ordinance will be presented to Council in
conjunction with the ordinance upon Second
Reading. The annexation agreement will have the
conditions stipulated by the Planning Commission
and the Council's options are to approve, reject,
or amend the agreement in conjunction with dealing
with the ordinance. Szymanski asked if it would
be more appropriate to discuss the proposed
annexation ordinance and Planning Commission's
conditions at the time of the Public Hearing.
Rautenstraus concurred.
The suggested action is to consider the annexation
on First Reading and set a Public Hearing for
April 15. 1986.
Szymanski indicated that he questions some of the
suggested conditions and is concerned with
approving the Ordinance on First Reading.
Rautenstraus stated that under the State Statutes
an Ordinance is considered on First Reading and a
Public Searing is set to adopt, deny or amend the
Ordinance on Second Reading. The suggested action
recommended simply states that Council agrees the
Ordinance should be published, notice of the
Public Rearing published and the Matter actually
be considered at the Rearing. Council can choose
not to consider the Ordinance should they feel the
Ordinance doesn't deserve to be heard and vote
tonight not to publish the Ordinance.
Mayor Pauson called for a vote of the motion on
the floor. The motion carried unanimously.
o8 DI IAMCt #114 - WARM:M[EOORG ZONIMG - FIRST READING
SIT PUBLIC REARING
Rautenstraus read by title only Ordinance f$84.
An Ordinance amending Title 17 of the Louisville
Municipal Code of the City of Louisville entitled
3
