Nundley suggested that this land also <br /> needs to be brought into the Louisville Fire Pro- <br /> tection District. <br /> Chuck Schmidt, Chief of the Louisville Fire <br /> Protection District, stated that there are two <br /> reasons behind this request: 1) a second station <br /> will be built approximately a quarter mile from <br /> this property which will give the businesses in <br /> the area a much better response times and 2) the <br /> City has adopted the National Fire Protection <br /> Code. The Romart property is currently in the <br /> Cherryvale Fire Protection District which operates <br /> under a different set of codes. In addition Louis- <br /> ville would then be dealing with an official from <br /> the Cherryvale Agency for building/fire inspec- <br /> tions. Schmidt stated that all annexed City of <br /> Louisville property should be covered by one fire <br /> protection agency. <br /> Dave Stahl, representing Romart Development Co., <br /> stated that in 1984, Louisville Associates, the <br /> predecessor to gomart Development Co., requested <br /> that this property be included in the Louisville <br /> Fire Protection District. Stahl reiterated that <br /> request stating that it would be important for <br /> them to be included in the LFPD. Stahl requested <br /> that they have an opportunity to review all <br /> documents, petitions, correspondence, etc. that <br /> may relate directly to Romart property before <br /> going to district court, LFPD or Cherryvale Fire <br /> Protection Agency. <br /> In response to Sackett's question regarding <br /> Council's role/responsibility in this action, <br /> Rautenstraus stated that the governing body of <br /> the municipality in which land has been annexed <br /> can petition district court to be excluded from <br /> one district and put into the other district. <br /> When districts are formed, they are formed through <br /> the district court. The City would have to <br /> petition the court to take this action and the <br /> LFPD is asking that the City Council sanction that <br /> step. <br /> Mayor Paulson asked if in the future annexation <br /> agreements could include a section wherein if the <br /> property is outside the LFPD, the property owners <br /> would automatically take care of this as part of <br /> annexation.
