Proper <br /> publication and notice of public hearing were <br /> established and Mayor Fauson opened the public <br /> hearing. <br /> Wanush stated that the property owners on either <br /> side of this pedestrian right-of-way are requesting <br /> it be vacated. Originally, the full 20' were needed <br /> for a walkway and an open drainage channel. The <br /> final Via Appia storm drainage study outlines a <br /> preferable alternative, so this area is no longer a <br /> drainageway. Staff recommended that rather than <br /> eliminating the right-of-way, it be reduced in width <br /> from 20' to 10' and McStain would still put in the <br /> sidewalk. Planning Commission voted to vacate the <br /> easement on each side by five feet and maintain a <br /> 10' right-of-way with a walkway to be designed in <br /> the future and to be designed with safety features <br /> in insure that bicycle traffic is not necessarily <br /> involved with Via Apple. <br /> Bruce Allen, 897 Cleveland Court, asked that Council <br /> consider vacating the entire right-of-way. He <br /> stated that residents in the neighborhood were <br /> concerned with children using a path that lets out <br /> onto Via Appia where motorist often drive faster <br /> than the posted 35 mph. <br /> Lynn Shook, 984 Cleveland, stated that the petition <br /> submitted to Council reflected the concerns and <br /> opinions of that neighborhood and asked that the <br /> entire right-of-way be vacated. <br /> Council discussion involved issues of safety, <br /> maintenance and City policy regarding this type of <br /> right-of-way. Mohr offered an amendment to the <br /> Ordinance which would vacate the entire right-of-way <br /> but to retain a ten foot easement for utility pur- <br /> poses, including all rights to maintain, replace and <br /> 2 <br />
