<br />ORDINANCE NO. 973 <br /> <br />AN ORDINANCE REPEALING AND REENACTING SECTION 13.24.020 <br />OF THE LOUISVILLE MUNICIPAL CODE <br />REGARDING PAYMENT OF SEWER TAP FEES <br /> <br /> <br />WHEREAS, city staff and City Council have reviewed City <br />procedures and the City Code with regard to sewer tap fees and <br />have determined that Section 13.24.020 of the Louisville <br />Municipal Code should be repealed and reenacted; <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Section 13.24.020 of the Louisville Municipal <br />Code is hereby repealed and reenacted as follows: <br /> <br />13.24.020. TAP FEE - GENERALLY. <br /> <br />A. Unless subsection 13.24.020(B) applies, no sewer tap <br />permit shall be issued until payment in full of the applicable <br />sewer tap fee. The owner shall be responsible for all labor, <br />materials and excavation necessary for installation of said sewer <br />tap. The City shall perform all necessary inspections to deter- <br />mine that all work performed is in accordance with the Uniform <br />Plumbing Code. <br /> <br />B. Payment of all applicable sewer tap fees may, at the <br />option of the owner, be deferred to a time not later than the <br />first SUbdivision of the subject property if each of the <br />following conditions is met: <br /> <br />(1) At the time the property is annexed to the City it is <br />zoned Planned Community Zone District ("PCZD"); <br /> <br />(2) At least thirty (30) acres of said property is zoned <br />commercial and/or industrial; and <br /> <br />(3) The requested tap is to service a preexisting use on <br />the property at the time of annexation. <br /> <br />If the owner elects to defer payment as provided in this <br />subsection, the amount of the fee shall be the amount in effect <br />at the time of paYment. <br />
