RESOLUTION NO. 12 A RESOLUTION SETTING FORTH FINDINGS OF FACT AND CONCLUSIONS RELATIVE TO THE ANNEXATION OF CERTAIN REAL PROPERTY LOCATED SOUTHWEST OF LOUISVILLE, OWNED BY MILDRED BUSH, THE COWDREY COMPANY AND SUPERIOR ASSOCIATES, LTD. WHEREAS, the City Counc i 1 of the City of Louisville has previously found a petition for annexation of certain property, described in Exhibit A attached hereto, to be in substantial compliance with Colorado Statutory requirements for annexation; and, WHEREAS, the City Counc i 1 of the City of Louisville has set Apr i 1 20, 1989 for a pub 1 i c hearing relative to said proposed annexation and has duly and properly advertised such hearing; and, WHEREAS, the City Counc i 1 of the City of Louisvil Ie has held said pub 1 i c heaT i ng and has heard evidence and testimony relative to determining if the proposed annexation complies with the statutory requirements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The City Counc i 1 hereby determines and finds that all applicable parts of Colorado Revised Statutes 31-12-104 and 31- 12-105 have been complied with, specifically including the following: (a) that not less than 1/6 of the perimeter of the area proposed to be annexed is contiguous with the annexing municipality; (b) that a community of interest exists between the area proposed to be annexed and the annexing municipality; (c) that said area is urban or wi 1 1 be urbanized in the near future; ( d ) that said area is integrated with or capable of being integrated with the annexing municipality. Section 2. I t is determined that no annexation election is required relative to this annexation. Section 3. I t is determined that no additional terms and conditions are to be imposed. THEREFORE, the City Counc i 1 specifically finds that all statutory requirements have been met and that the described property may be properly annexed to the City of Louisville by Ordinance.
