<br /> RES 0 L UTI 0 N NO. 11 <br /> ---------- <br /> A RESOLUTION DECLARING THE INTENTION OF THE <br /> CITY COUNCIL OF THE CITY OF LOUISVILLE, <br /> COLORADO, TO CREATE A SPECIAL IMPROVEMENT <br /> DISTRICT WITHIN THE CITY, TO BE DESIGNATED AS <br /> SPECIAL IMPROVEMENT DISTRICT NO. 1989-1, <br /> ADOPTING DETAILS AND SPECIFICATIONS THEREFOR, <br /> AND ORDERING PUBLICATION AND MAILING OF A <br /> NOTICE OF HEARING TO THE OWNERS OF THE <br /> PROPERTY TO BE ASSESSED FOR IMPROVEMENTS IN <br /> SAID DISTRICT. <br /> WHEREAS, the City Council (the "Council") of the City of <br /> Louisville, Colorado (the "City"), has determined that it is <br /> necessary to create a special improvement district and to <br /> construct certain improvements therein, as described in this <br /> resolution (the "Resolution"); and <br /> WHEREAS, in accordance with ~31-25-503 (1) (d) , C.R.S. , <br /> any improvement may be initiated directly by a resolution of the <br /> Council declaring its intention to construct the improvements; and <br /> WHEREAS, the Council shall consider all protests and <br /> objections that may be made in connection with the proposed <br /> improvements, before ordering the construction thereof; and <br /> WHEREAS, pursuant to an order of the Council, the city's <br /> Director of Public Works has prepared and filed preliminary plans, <br /> specifications, an estimate of cost, maps, and schedules for the <br /> improvements; and <br /> WHEREAS, in accordance with ~31-25-503(1) (d), C.R.S. , it <br /> is necessary that a preliminary order be made, adopting <br /> preliminary plans and specifications, definitely describing the <br /> materials to be used, determining the number of installments and <br /> the time in which the cost of the improvements shall be payable, <br /> the property to be assessed for the cost of the improvements, and <br /> requiring an estimate of such cost together with a map of the <br /> proposed district, and a schedule showing the approximate amounts <br /> to be assessed on the lots and parcels of property within the <br /> proposed district; and <br /> WHEREAS, this Resolution shall constitute the prelimi- <br /> nary order required by law; <br /> - 2 - <br />
