RES 0 L UTI 0 N NO. 11 ---------- A RESOLUTION DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO, TO CREATE A SPECIAL IMPROVEMENT DISTRICT WITHIN THE CITY, TO BE DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NO. 1989-1, ADOPTING DETAILS AND SPECIFICATIONS THEREFOR, AND ORDERING PUBLICATION AND MAILING OF A NOTICE OF HEARING TO THE OWNERS OF THE PROPERTY TO BE ASSESSED FOR IMPROVEMENTS IN SAID DISTRICT. WHEREAS, the City Council (the "Council") of the City of Louisville, Colorado (the "City"), has determined that it is necessary to create a special improvement district and to construct certain improvements therein, as described in this resolution (the "Resolution"); and WHEREAS, in accordance with ~31-25-503 (1) (d) , C.R.S. , any improvement may be initiated directly by a resolution of the Council declaring its intention to construct the improvements; and WHEREAS, the Council shall consider all protests and objections that may be made in connection with the proposed improvements, before ordering the construction thereof; and WHEREAS, pursuant to an order of the Council, the city's Director of Public Works has prepared and filed preliminary plans, specifications, an estimate of cost, maps, and schedules for the improvements; and WHEREAS, in accordance with ~31-25-503(1) (d), C.R.S. , it is necessary that a preliminary order be made, adopting preliminary plans and specifications, definitely describing the materials to be used, determining the number of installments and the time in which the cost of the improvements shall be payable, the property to be assessed for the cost of the improvements, and requiring an estimate of such cost together with a map of the proposed district, and a schedule showing the approximate amounts to be assessed on the lots and parcels of property within the proposed district; and WHEREAS, this Resolution shall constitute the prelimi- nary order required by law; - 2 -
