<br /> ~ <br /> RESOLUTION NO. 9 <br /> Series 1989 <br /> A RESOLUTION AMENDING RESOLUTION NO. 52, SERIES 1988, <br /> WITH RESPECT TO THE DEDICATION OF WATER RIGHTS TO THE <br /> CITY IN CONNECTION WITH ANNEXATIONS <br /> WHEREAS, pursuant to fi16.32.030(G) of the Louisville <br /> Municipal Code, the City Council, from time to time, is to set <br /> forth by resolution the city policy with respect to conveyance of <br /> water rights to the City in connection with annexation; and <br /> WHEREAS, the City Council adopted Resolution No. 52, Series <br /> 1988 on November 15, 1988; and <br /> WHEREAS, the city staff and the City Council of the City of <br /> Louisville have determined that Resolution No. 52, Series 1988 <br /> should be revised; <br /> NOW, THEREFORE, BE IT RESOLVED that the City of Louisville <br /> hereby amends paragraph no. 7 of Resolution No. 52, Series 1988, <br /> to read as follows: <br /> 7. For land to be zoned residential, if the Raw Water <br /> Credits available from water rights offered and <br /> accepted by the City are less than the Net Acreage, a <br /> cash payment in lieu of dedication or to supplement <br /> dedication shall be required in the amount of $1,290.00 <br /> per acre times the difference between the Net Acreage <br /> and the number of Raw Water Credits available. This <br /> fee shall be collected upon approval of the first <br /> SUbdivision of the subject property or at such other <br /> time(s) as the City may provide in a written agreement <br /> with the annexor or his successors. <br /> In all other respects, Resolution No. 52, Series 1988, is <br /> hereby ratified and affirmed. <br /> PASSED AND ADOPTED this 7th day of March, 1989. <br /> CITY OF LOUISVILLE <br /> By ~ <br /> Herman Fauson, Mayor <br />
