<br />RESOLUTION NO. 3~ <br /> <br />Series 1988 <br /> <br />A RESOLUTION SETTING FORTH FINDINGS OF <br />FACT AND CONCLUSIONS RELATIVE TO THE <br />ANNEXATION OF CERTAIN REAL PROPERTY <br />LOCATED ALONG COAL CREEK BETWEEN DILLON <br />ROAD AND CHERRY STREET AND MORE <br />PARTICULARLY DESCRIBED HEREIN. <br /> <br /> <br />WHEREAS, the ci ty Council of the ci ty of Louisville has <br />previously found a petition for annexation of certain property, <br />described in Exhibit A attached hereto, to be in substantial <br />compliance with Colorado statutory requirements for annexation; <br />and <br /> <br />WHEREAS, the City Council of the City of Louisville has set <br />January 5, 1988 for a public hearing relative to said proposed <br />annexation and has duly and properly advertised such hearing; and <br /> <br />WHEREAS, the City Council of the City of Louisville has held <br />said public hearing and has heard evidence and testimony relative <br />to determining if the proposed annexation complies with the <br />statutory requirements. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />section 1. The City Council hereby determines and finds <br />that all applicable parts of Colorado Revised statutes 31-12-104 <br />and 31-12-105 have been complied with, specifically including the <br />following: <br /> <br />(a) that not less than 1/6 of the perimeter <br />of the area proposed to be annexed is <br />contiguous with the annexing municipality; <br /> <br />(b) that a communi ty of interest exists <br />between the area proposed to be annexed and <br />the annexing municipality; <br /> <br />(c) that said area is urban or will be <br />urbanized in the near future; <br /> <br />(d) that said area is integrated with or <br />capable of being integrated with the annexing <br />municipality. <br />
