PAUL FIRE AND MARINE INSURANCE COMPANY P O Box 271247 Fort Collins, CO 80527 Telephone: (970) 204 -1396 Fax: (720) 223 -3019 Dear Ms. Balser, I am in receipt of and have been able to review the Resolution No.16, Series 2001 as well as the above referenced lawsuit and your applicable policy language. I have determined there is no coverage for this matter under your policy number GP09304406, issued by our company. The reasons for no coverage are due to the following exclusions in that policy: Boards and commissions. We won't cover loss that results from the activities or operations of the following boards, commissions, or governmental units: Electric and Gas Utilities Complaint or enforcement action. We won't cover loss that results from any complaint, enforcement action, claim or suit brought by or for any federal, state, or local governmental regulatory or enforcement agency against any protected person. Contract liability. We won't cover loss for which the protected person has assumed liability under a contract or agreement. However, we won't apply this exclusion to liabilty for loss any protected person would have without the contract or agreement. In addition to the above exclusions contained in your policy, a review of the allegations in the lawsuit shows there is no claim for any bodily injury or property damage. If you have any additional information that may change this decision, please send that information to me in writing and I will review this decision further. A copy of this letter is being sent to Samuel Light, your City Attorney, as well as your agent, Flood and Peterson Insurance Company.
