PAUL FIRE AND MARINE <br />INSURANCE COMPANY <br />P O Box 271247 <br />Fort Collins, CO 80527 <br />Telephone: (970) 204 -1396 <br />Fax: (720) 223 -3019 <br />Dear Ms. Balser, <br />I am in receipt of and have been able to review the Resolution No.16, Series 2001 as well as the <br />above referenced lawsuit and your applicable policy language. I have determined there is no <br />coverage for this matter under your policy number GP09304406, issued by our company. The <br />reasons for no coverage are due to the following exclusions in that policy: <br />Boards and commissions. We won't cover loss that results from the activities or operations of the <br />following boards, commissions, or governmental units: Electric and Gas Utilities <br />Complaint or enforcement action. We won't cover loss that results from any complaint, enforcement <br />action, claim or suit brought by or for any federal, state, or local governmental regulatory or <br />enforcement agency against any protected person. <br />Contract liability. We won't cover loss for which the protected person has assumed liability under a <br />contract or agreement. However, we won't apply this exclusion to liabilty for loss any protected <br />person would have without the contract or agreement. <br />In addition to the above exclusions contained in your policy, a review of the allegations in the lawsuit <br />shows there is no claim for any bodily injury or property damage. <br />If you have any additional information that may change this decision, please send that information to <br />me in writing and I will review this decision further. A copy of this letter is being sent to Samuel <br />Light, your City Attorney, as well as your agent, Flood and Peterson Insurance Company. <br />
