RESOLUTION NO. 15 <br />SERIES 2001 <br /> <br /> A RESOLUTION APPROVING <br /> A FINAL PUD DEVELOPMENT PLAN <br /> FOR LOTS 4 AND 5, BLOCK 4, <br />THE BUSINESS CENTER AT CTC, REPLAT D <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a final PUD development plan for two buildings on Lots 4 and 5, Block 4, The <br />Business Center at CTC, Replat D; and <br /> <br /> WHEREAS, all materials related to the final PUD development plan have been reviewed <br />by City Staff and the Planning Commission and found, with conditions, to be in compliance with <br />the Louisville zoning ordinances, subdivision regulations, the Industrial Development Design <br />Standards and Guidelines, related policies and previous approvals; and <br /> <br /> WHEREAS, after a duly noticed public heating concerning said final PUD development <br />plan on February 22, 2001, where evidence and testimony were entered into the public record, <br />including the Staff Report dated February 22, 2001, the Planning Commission recommended <br />approval to the City Council, with conditions; and <br /> <br /> WHEREAS, City Council has reviewed the application and finds that the Planning <br />Commission recommended conditions have been addressed in the plans submitted for City <br />Council action and further finds that said final PUD development plan should be approved, with <br />the following conditions: <br /> <br />The final design of the northern driveway onto CTC Boulevard shall be subject to final <br />approval during the civil plan review process. The applicant shall agree to coordinate with <br />the property owner to the north for a possible shared driveway, unless that proves a <br />technical or timing impossibility. <br /> <br />2. The applicant shall dedicate a public sidewalk easement along CTC Boulevard at or prior to <br /> recording of the final PUD. <br /> <br />3. Cross access and shared detention easements/agreements shall be recorded at or prior to <br /> recording of the final PUD. <br /> <br />4. An off-site grading easement for the property east of Lot 4 shall be recorded at or prior to <br /> recording of thefinal PUD. <br /> <br />The RipRap proposed for the pond emergency spillway shall be reduced if possible and the <br />landscape plan shall be modified if necessary, .without reducing the amount of plant <br />materials currently proposed. <br /> <br /> <br />
