If the voters decided to <br /> retain the position of City Treasurer as <br /> elected what could/would need to be done to <br /> bring the municipal code to conformance with <br /> the actual situation? The sole duty of the <br /> Treasurer is to sign checks; the Finance <br /> Director performs all the duties ascribed to <br /> the Treasurer in the Municipal Code. <br /> Municipal Code basically is consistent with <br /> state statutes and we don't see anything <br /> necessarily inconsistent with either of the <br /> terms of the current practice. City Treasur- <br /> er remains responsible for those functions <br /> that are set out in the city code and the <br /> state statutes. The Finance Director may <br /> certainly perform those responsibilities <br /> essentially as delegated by the City Treasur- <br /> er but the City Treasurer has not lost the <br /> responsibility so in a sense the City Treas- <br /> urer is in effect still responsible for <br /> performing those functions even though they <br /> may be actually performed by the Finance <br /> Director. The minimum that might have to be <br /> done if it has not been done is to just make <br /> it clear that the Finance Director in per- <br /> forming those functions, is essentially <br /> acting as the Deputy Treasurer of the City. <br /> Question No. 9. If the Mayor and Council <br /> decide to continue the City Clerk position as <br /> an elected position (not taking the question <br /> to the voters) , could the term of the City <br /> Clerk and the City Treasurer be staggered so <br /> that the election doesn't occur at the same <br /> time as Mayor and three Council positions? <br /> By statutes if the positions are elected, <br /> Mayor, City Clerk and City Treasurer all must <br /> be selected at the same election. We don't <br /> see a way, at least at this point and time to <br /> separate that out. <br />Hornbostel: My questions is on logistics.
