I don't see why they could not so <br />long as you have the clerk who approved the <br />appointment of the individual involved. If <br />the clerk says no I don't want this individu- <br />al then what will occur as a practical matter <br />is that the clerk is not going to permit that <br />individual to perform the functions of the <br />clerk and it won't matter about personnel <br />rUles/regulations. <br /> <br />Question No.5. On page 2 of Scott Ross' memo <br />to Susan Griffiths (March 18, 1991), second <br />paragraph, the statement is made: "An ap- <br />pointed City Clerk is subject to the control <br />and direction of the Mayor." Why would that <br />be true in Louisville? What are the report- <br />ing options for an appointed City Clerk? <br /> <br />The statement is true for the City of Louis- <br />ville, because Louisville is a statutory city <br />and the state statutes provide in 31-4- <br />107(2) (b) that all appointive officers of the <br />City are subject to the direction and control <br />of the Mayor. They may be removed by the City <br />Council from their position but they are <br />subject to the control and direction of the <br />Mayor under state statutes and that is not <br />something that by Ordinance could be altered. <br />Consequently to the extent that the position <br />becomes an appointed position, it is subject <br />to the direction and control of the Mayor as <br />other city appointed officers are, including <br />the City Administrator, City Attorney and <br />anyone else who is identified as an officer <br />of the City. <br /> <br />Question No.6. Mayor and Council need to <br />consider the appointment of an interim City <br />Clerk until an election can be held. The <br />actual and practical situation is that Linda <br />Salas, who lives in Lafayette, is performing <br />the duties (and has been performing most of <br />those duties since Pam Ferris resigned). <br />What options are available to Mayor and <br />Council in appointing an interim City Clerk? <br /> <br />The principal requirements that would have to <br />be met in appointing an interim City Clerk or <br />acting City Clerk is that they meet the same <br />requirements that the person who was elected <br />would have to meet. In other words, so long <br />as the position is an elected position those <br />requirement must be met and those require- <br /> <br /> <br />8 <br />
