All in favor.
ORDINANCE NO. 1044, SERIES 1991 - AMENDING THE LOUISVILLE MUNICI-
PAL CODE TO MAKE THE CITY CLERK POSITION APPOINTIVE RATHER THAN
ELECTIVE IF APPROVED BY THE REGISTERED ELECTORS OF LOUISVILLE,
AND CALLING A SPECIAL ELECTION THEREON - 1ST READING - SET FOR
PUBLIC HEARING
Griffiths read by title only, Ordinance No. 1044, Series 1991,
"An Ordinance making the position of City Clerk appointive rather
than elective if approved by the voters of the City of Louis-
ville, and calling a special election thereon."
Griffiths: I would like to answer one question that was
raised at the last Council meeting. Council-
woman Hornbostel asked what happens if this
question of making the position of City Clerk
appointive rather than elective was placed on
the November ballot rather than a special
election. If it passed, the state statutes
provide that any measure making the clerk's
position or treasurer's position appointive
rather than elective must take effect in a
manner so as to avoid shortening anyone's
terms of office. If it was put on the Novem-
ber election ballot and if it passed and if
there were candidates for the positions on
the November election ballot then those
persons elected would serve their complete
terms prior to the time the ordinance took
effect.
Hornbostel: Would that be a two or four year term?
Griffiths: It would be four year terms for the Treasurer
and City Clerk. I was asked to draft the
ordinance before you, the ordinance has
three sections to it; first section makes
changes to the Louisville Code that would
make the City Clerk's position appointive;
section 2 . on page two states those changes
would not take effect unless a majority of
the registered electors voting thereon at a
special election voted in favor of making the
position of City Clerk appointive; section 3.
calls a special election for August 6, 1991.
If you chose to do so then I would just point
out that given all the time requirements that
exists in the Municipal election code the
only date available to have a special elec-
tion prior to the regular election would be
7
--
