Staff recommends the fee be <br />equal to the City's legal fee for drafting and reviewing the agreement. <br />Griffiths recommended adding to the end of the paragraph the language; "More <br />particularly, described in Exhibit A, attached hereto and incorporated herein by this <br />reference." The addition of that language would ensure that the location of the licensed <br />property was more specifically located on a legal description or map and that would be <br />attached to the license agreement. <br />Howard moved to approve the license agreement and authorize the Mayor to sign such <br />agreement and to include the amendment as worded by the City Attorney, seconded by <br />Hornbostel. All in favor. <br />DISCUSSION/DIRECTION - OPEN SPACE LAND USAGE REQUEST <br />Staff has been contacted by Al Owen requesting a lease arrangement for usage of open <br />space land to pasture horses. The City's legal council has reviewed the request. <br />Randy Coombs, Resource Specialist with Boulder County Parks and Open Space has <br />provided city staff with a copy of a lease agreement used by Boulder County. The lease <br />agreement addresses a request similar to that being made to the City of Louisville. <br />Staff is requesting direction from Council as to whether to pursue a lease agreement with <br />Mr. Owen or any other interested parties regarding agricultural usage of City Open Space. <br />Howard: If we have horses on City owned land, any <br /> damage or destruction made by the horses would <br /> the City be liable for them? <br />Griffiths: I think it would be incumbent upon us to ensure <br /> that the lease agreement provides that any such <br /> liability would not be that of the City, but would <br /> be assumed by the lessee of the property. We <br /> would include in the lease some provision to <br /> ensure that the funds would be available to pay <br /> those damages if they occurred.
