RESOLUTION NO. 12 <br />SERIES 2001 <br /> <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT <br />ESTABLISHING BOULDER COUNTY AS THE SUCCESSOR ENTITY TO THE <br />BOULDER COUNTY RECYCLING AND COMPOSTING AUTHORITY <br /> <br /> WHEREAS, the Boulder County Recycling and Composting Authority (BCRCA) was <br />established by Intergovernmental Agreement dated April 20, 1995; and <br /> <br /> WHEREAS, the 1995 Agreement provides that it shall terminate automatically on <br />December 31, 2001, or that it may be terminated prior to then by agreement of the parties; and <br /> <br /> WHEREAS, an intergovernmental agreement has been proposed among Boulder County, <br />the Cities of Louisville, Broomfield, Boulder, Lafayette and Longmont, and the Towns of Lyons, <br />Jamestown, Nederland and Superior in order to terminate the 1995 Agreement and establish Boulder <br />County as the successor entity to the BCRCA; and <br /> <br /> WHEREAS, the City is authorized to enter into such agreement pursuant to C.RS. Section <br />29-1-201 et seq.; and <br /> <br /> WHEREAS, the City Council finds that the proposed intergovernmental agreement is in the <br />best interests of the City and its citizens. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> 1. The proposed Intergovemmental Agreement Establishing Boulder County as the <br />Successor Entity to the Boulder County Recycling and Composting Authority is hereby approved in <br />essentially the same form as the copy of such Intergovernmental Agreement accompanying this <br />Resolution. <br /> <br /> 2. The Mayor is hereby authorized to execute the attached Intergovernmental Agreement <br />on behalf of the City Council of the City of Louisville, except that the Mayor is hereby granted the <br />authority to negotiate and approve such revisions to said Agreement as the Mayor determines are <br />necessary or desirable for the protection of the City, so long as the essential terms and conditions of the <br />Intergovernmental Agreement are not altered. <br /> <br />PASSED AND ADOPTED this 20th day of February 2001. <br /> <br /> <br />
