RESOLUTION NO. 12 SERIES 2001 A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT ESTABLISHING BOULDER COUNTY AS THE SUCCESSOR ENTITY TO THE BOULDER COUNTY RECYCLING AND COMPOSTING AUTHORITY WHEREAS, the Boulder County Recycling and Composting Authority (BCRCA) was established by Intergovernmental Agreement dated April 20, 1995; and WHEREAS, the 1995 Agreement provides that it shall terminate automatically on December 31, 2001, or that it may be terminated prior to then by agreement of the parties; and WHEREAS, an intergovernmental agreement has been proposed among Boulder County, the Cities of Louisville, Broomfield, Boulder, Lafayette and Longmont, and the Towns of Lyons, Jamestown, Nederland and Superior in order to terminate the 1995 Agreement and establish Boulder County as the successor entity to the BCRCA; and WHEREAS, the City is authorized to enter into such agreement pursuant to C.RS. Section 29-1-201 et seq.; and WHEREAS, the City Council finds that the proposed intergovernmental agreement is in the best interests of the City and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The proposed Intergovemmental Agreement Establishing Boulder County as the Successor Entity to the Boulder County Recycling and Composting Authority is hereby approved in essentially the same form as the copy of such Intergovernmental Agreement accompanying this Resolution. 2. The Mayor is hereby authorized to execute the attached Intergovernmental Agreement on behalf of the City Council of the City of Louisville, except that the Mayor is hereby granted the authority to negotiate and approve such revisions to said Agreement as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Intergovernmental Agreement are not altered. PASSED AND ADOPTED this 20th day of February 2001.
