94-162 which referred that issue to the ballot. Authorized uses of the Recycling Tax <br />Fund include but are not limited to: <br /> <br />A reserve fund in the mount of $5.2 million ($5,200,000) to cover equipment <br />replacement and building refurbishment, unforeseen circumstances in <br />materials markets, or for such emergency situations as may arise. <br /> <br />· Completing construction of the Recycling Processing Center <br /> <br />· Operation and maintenance of the Recycling Processing Center and <br /> equipment <br /> <br />Construction, operation and maintenance of composting facilities and <br />equipment, and expansion of the household hazardous waste facility and such <br />other facilities and/or operations as are deemed by the Board of County <br />Commissioners to be fiscally prudent and to further the goals of the 1995 <br />Agreement. Such decisions shall be made after input and recommendations <br />from the BCRCA Advisory Committee have been made. <br /> <br />· Employment of necessary staff <br /> <br />An Advisory Committee will be formed following execution of this <br />Agreement to provide input and recommendations to Boulder County <br />on matters affecting the facilities. The Committee will include one <br />appointed representative from each of the cities' and towns in the <br />county and from the unincorporated county, plus one from the City <br />and County of Broomfield. Boulder County will appoint five <br />additional at-large members to reflect the population distribution <br />throughout the county. Each appointing entity will determine <br />whether its member will be a staff member, citizen or elected <br />official. <br /> <br />By this Agreement, Boulder County agrees to own and maintain the <br />Recycling Processing Center ("RPC"). Should Boulder County <br />desire to sell the RPC, such decision shall first be affirmed by a <br />majority affirmative vote of the town boards or councils who are <br />parties to this Agreement. In tallying the vote on the issue of sale of <br />the RPC, each city council, town board or city/county shall cast a <br />weighted vote based on the population of their jurisdiction, and the <br />Board of County Commissioners of Boulder County will cast the <br />vote for the unincorporated population. In the event of the sale of the <br />RPC, the value of the assets sold shall be divided between the <br />jurisdictions which are party to this Agreement in proportion to each <br />of their contributions to the sales and use tax funds collected during <br />the term of the 1995 Agreement. These distributed funds may only <br />be used for the purposes described in paragraph 2, above, except in <br /> <br /> <br />
