SUMMARY: <br />The applicant requests approval of a Planned Unit Development (PUD), Special Review <br />Use (SRU), Plat, Easement Vacation, and Annexation Agreement Amendment to allow <br />the development of a distillery, tasting room and event space and associated site <br />improvements at 1303 Empire Road. <br />Staff recommends approval of Resolution 19, Series 2023, approving the PUD, SRU, <br />Plat, Easement Vacation, and Annexation Agreement Amendment, with two conditions: <br />• That the Annexation Agreement, and all references to it on the Plat and PUD, be <br />amended to move the location of the development restriction on the property, <br />outlined in Section 3 of the Agreement and referred to as the "No Building Zone" <br />on the 2005 Plat, to accommodate the proposed main building of the Ironton <br />PUD. The development restriction would remain to the west of the main building, <br />with the exception that landmarked structures be allowed in the No Building <br />Zone. <br />That the application undergo a third referral to address any remaining comments <br />described in the Second Referral Response letter dated November 22, 2023 <br />(Attachment 6). <br />BACKGROUND: <br />The property is zoned Industrial and is located within the Empire Road subdivision, <br />platted in 2005. The area was annexed into the City of Louisville from Boulder County in <br />1986 under the Trousil Annexation Agreement along with the property zoned Industrial <br />to the east on the north side of Empire Road. At that time, the properties were zoned <br />Light Industrial with the County. There is an existing building on the subject property <br />that was built in 1982, prior to annexation. Today, directly east of the property, there is <br />private property zoned Industrial and currently used as a storage facility. Further east, <br />there is a City -owned property colloquially referred to as the old City Shops (leased by <br />Figure 1.
