• <br />• <br />• <br />(1) The building permit application is for major structural repair or <br />rebuilding of a residence that sustained fire damage from the Mar- <br />shall Fire, or for repair or rebuilding of a primary residential struc- <br />ture that sustained smoke, heat, water, ash or other damage from <br />the Marshall Fire not consisting solely of smoke or ash damage, <br />that rendered the residence not habitable; <br />(2) The building permit application has been filed by the owner of <br />record of the property, or an authorized representative, and such <br />person was the owner of record on December 30, 2021; <br />(3) The building permit application was filed on or before Decem- <br />ber 31, 2024 and <br />(4) The applicant certifies that a financial hardship prevents com- <br />pletion of the work to be performed in accordance with the 2021 <br />IECC due to inadequate insurance coverage. <br />Section 2. Section 15.18.020 of the Louisville Municipal Code is here- <br />by amended to read as follows (words to be added underlined; <br />words to be deleted stricken): <br />Sec. 15.18.020. Appendices to 2021 IECC Adopted. <br />The following appendices of the 2021 International Energy Conser- <br />vation Code are hereby specifically adopted; any appendices not <br />listed are not adopted: Appendix RC, Zero Energy Residential Build- <br />ing Provisions, Appendix CB. Solar Ready Zone - Commercial and <br />Appendix RB, Solar Ready Provisions - Detached One and Two - <br />Family Dwellings and Townhouses. Group R2, R3, and R4, three sto- <br />ries or less shall comply with Appendix RB. A building permit appli- <br />cant may request not to comply with Appendix RC, Zero Energy <br />Residential Building Provisions, for major structural repair or re- <br />building of a residential property that sustained fire damage from <br />the Marshall Fire, or for repair or rebuilding of a primary residential <br />structure that sustained smoke, heat, water, ash or other damage <br />from the Marshall Fire, which request shall be approved by the <br />Chief Building Official upon finding the criteria in Section <br />15.18.010(b)(1)-(3) are all met and the applicant certifies that a fi- <br />nancial hardship prevents completion of the work to be performed <br />in accordance with Appendix RC of the 2021 IECC due to inadequate <br />insurance coverage. <br />Section 3. If any portion of this ordinance is held to be invalid <br />for any reason, such decision shall not affect the validity of the re- <br />maining portions of this ordinance. The City Council hereby de- <br />clares that it would have passed this ordinance and each part here- <br />of irrespective of the fact that any one part be declared invalid. <br />Section 4. The repeal or modification of any provision of the <br />Municipal Code of the City of Louisville by this ordinance shall not <br />release, extinguish, alter, modify, or change in whole or in part any <br />penalty, forfeiture, or liability, either civil or criminal, which shall <br />have been incurred under such provision, and each provision shall <br />be treated and held as still remaining in force for the purpose of <br />sustaining any and all proper actions, suits, proceedings, and pros- <br />ecutions for the enforcement of the penalty, forfeiture, or liability, <br />as well as for the purpose of sustaining any judgment, decree, or <br />order which can or may be rendered, entered, or made in such ac- <br />tions, suits, proceedings, or prosecutions. <br />Section 5. All other ordinances or portions thereof inconsis- <br />tent or conflicting with this ordinance or any portion hereof are <br />hereby repealed to the extent of such inconsistency or conflict. <br />Section 6. As set forth in Section 15.18.070, it shall be unlawful for <br />any person, firm, or corporation to erect, construct, enlarge, alter, <br />repair, move, improve, remove, convert or demolish, equip, use, oc- <br />cupy or maintain any building or structure or cause or permit the <br />work to be done, in violation of the provisions of Chapter 15.18 of <br />the Louisville Municipal Code or the terms of the code or standards <br />adopted and incorporated in Chapter 15.18. Any person convicted <br />of a violation of any provision of this chapter or of the provisions of <br />the code or standards adopted and incorporated in this chapter <br />shall be subject to the penalty provided in Section 1.28.010 of the <br />Louisville Municipal Code. <br />INTRODUCED, READ, PASSED ON FIRST READING, AND OR- <br />DERED PUBLISHED this 28th day of November, 2023. <br />Christopher M.
