RESOLUTION NO. 3 <br />SERIES 2001 <br /> <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL <br />AGREEMENT AMONG THE CITY OF LOUISVILLE, CITY OF <br />LAFAYETTE, CITY OF BROOMFIELD, COUNTY OF BOULDER AND <br />NORTHWEST PARKWAY AUTHORITY. <br /> <br /> WHEREAS, the City of Louisville, City of Lafayette, City of Broomfield and County of <br />Boulder have previously entered into an Intergovernmental Agreement entitled Southeast Boulder <br />County, South 96th Street, Dillon Road, and U.S. 287 Area Comprehensive Development Plan, <br />which is dated February 18, 1999; and <br /> <br /> WHEREAS, there has been proposed among the City of Louisville, City of Lafayette, City <br />of Broomfield, County of Boulder and Northwest Parkway Authority an Intergovernmental <br />Agreement Amending the Southeast Boulder County, South 96th Street, Dillon Road, and U.S. 287 <br />Area Comprehensive Development Plan Intergovernmental Agreement; and <br /> <br /> WHEREAS, the City is authorized to execute the proposed intergovernmental agreement <br />pursuant to state law, including but not limited to Colorado Constitution Article XIV, Section 18, <br />and C.R.S. {}{}29-1-201, et seq. and 29-20-105; and <br /> <br /> WHEREAS, the City Council has held a public heating on the proposed intergovernmental <br />agreement after proper public notice; and <br /> <br /> WHEREAS, the City Council finds that the proposed intergovernmental agreement is in <br />the best interests of the City and its citizens. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The proposed Intergovernmental Agreement Amending the Southeast Boulder <br />County, South 96th Street, Dillon Road, and U.S. 287 Area Comprehensive Development Plan <br />Intergovernmental Agreement, a copy of which is attached hereto and incorporated herein by this <br />reference, is hereby approved. <br /> <br /> 2. The Mayor is hereby authorized to execute the attached Intergovemmental <br />Agreement on behalf of the City Council of the City of Louisville, subject to the requirement that <br />the Agreement be executed by the City of Broomfield, the City of Lafayette, the County of Boulder <br />and the Northwest Parkway Authority. The Mayor may not execute the Agreement if it will not be <br />executed by such entities. The Mayor is also hereby granted the authority to negotiate and approve <br /> <br /> <br />
