RESOLUTION NO. 54 <br />SERIES 2001 <br /> <br /> A RESOLUTION APPROVING AMENDMENTS TO CONSERVATION <br />EASEMENTS OVER A PORTION OF THE WAREMBOURG PROPERTY AND <br />APPROVING A RELATED GRANT AGREEMENT WITH THE STATE BOARD OF THE <br />GREAT OUTDOORS COLORADO TRUST FUND <br /> <br /> WHEREAS, the City of Louisville ("City") and the County of Boulder ("County") each <br />own a 50% undivided interest in fee simple title to a 220-acre parcel of land located at the <br />northwest comer of the intersection of Dillon Road and South 96th Street, which land is <br />commonly referred to as the Warembourg Property, Parcel 1 and which is more particularly <br />described in Exhibit A to the Amendment to Deed of Conservation Easement in Gross which <br />accompanies this Resolution (hereinafter the "Property"); and <br /> <br /> WHEREAS, the Property, which the City and County acquired in 1999, is subject to <br />reciprocal conservation easements from the City to County and the County to City recorded <br />August 18, 1999 at, respectively, Reception Nos. 1972589 and 1972588, Boulder County <br />Records (the "Conservation Easements"); and <br /> <br /> WHEREAS, the City and County are to receive a grant from the State Board of the Great <br />Outdoors Colorado Trust Fund (the "Board") to assist in funding the City and County's <br />acquisition of the Property; and <br /> <br /> WHEREAS, in furtherance of such grant from the Board, the City and County desire to <br />execute a Grant Agreement with the Board, and further desire to amend the Conservation <br />Easements to incorporate certain provisions which are required by the Board and which are <br />intended to further preserve for scenic, open space, agricultural, passive recreational and <br />environmental uses, the natural condition and aesthetic and ecological features of the Property; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The Proposed Amendment to Deed of Conservation Easement in Gross between the <br />City of Louisville and the County of Boulder ("Amendment") is hereby approved in essentially the <br />same form as the copy of such Amendment accompanying this Resolution. <br /> <br /> 2. The proposed Grant Agreement among the City of Louisville, County of Boulder <br />and State Board of the Great Outdoors Colorado Trust Fund ("Grant Agreement") is hereby <br />approved in essentially the same form as the copy of such Grant Agreement accompanying this <br />Resolution. <br /> <br /> 3. The Mayor is authorized to execute the Grant Agreement and Amendment on behalf <br />of the City, including a separate version of the Amendment for each of the Conservation <br />Easements, and the Mayor is hereby further granted authority to negotiate and approve such <br /> <br /> <br />
