Boulder County Clerk, CO ACE R 0.00 AMENDMENT TO DEED OF CONSERVATION EASEMENT IN GROSS (Warembourg Property Parcel 1/County to City Conservation Easement ) NOTICE: A GRANT FROM THE STATE BOARD OF THE GREAT OUTDOORS COLORADO TRUST FUND HAS BEEN UTILIZED TO ASSIST IN THE ACQUISITION OF THIS PROPERTY. THIS AMENDMENT CONTAINS RESTRICTIONS ON THE USE AND DEVELOPMENT OF THE PROPERTY WHICH ARE INTENDED TO PROTECT ITS OPEN SPACE VALUES. THE STATE BOARD OF THE GREAT OUTDOORS COLORADO TRUST FUND HAS FOUND THAT THE ADOPTION OF THESE RESTRICTIONS IS IN THE PUBLIC INTEREST. 2224741 Page: 1 of 16 11/29/2001 01:31P D 0.00 RECITALS A. The City of Louisville, a municipal corporation duly organized and existing under and by virtue of the laws of the State of Colorado (the "City") and the County of Boulder, a body corporate and politic (the "County") each own a 50% undivided interest in fee simple title to that specific parcel of real property located in Boulder County, Colorado, legally, described on Exhibit A attached hereto and incorporated herein by this reference (the "Property"). B. The Property is subject to reciprocal conservation easements from the City to County and the County to City recorded August 18, 1999 at respectively Reception Nos. 1972589 and 1972588, Boulder County records (the "Conservation Easements"). C. City and County have received a grant from the State Board of the Great Outdoors Colorado Trust Fund (the "Board"), and desire to amend the Conservation Easements to incorporate certain provisions required by the Board and to preserve for scenic, open space, agricultural, passive recreational and environmental uses, the natural condition and aesthetic and ecological features (collectively the "Conservation Values") of the Property. D. This Amendment is to the Conservation Easement from the County to the City recorded at Reception No. 1972588. For purposes of this amendment, Grantor shall refer to the County and Grantee shall refer to the City. The parties are also executing this day an amendment to the conservation easement recorded at Reception No. 1972589. AGREEMENT NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is acknowledged by the parties, City and County hereby amend the Conservation Easement in Gross recorded on August 18, 1999 at Reception No. 1972588 as follows:
