Section 3.5 of the Conservation Easement is amended to read as follows: <br /> <br /> 3.5 No commercial signs, billboards, awnings, or advertisements shall be <br />displayed or placed on the Property, except for appropriate and customary ranch or <br />pasture identification signs, "for sale" or "for lease" signs alerting the public to the <br />availability of the Property for purchase or lease, "no trespassing" signs, signs regarding <br />the private leasing of the Property for hunting, fishing or other low impact recreational <br />uses, and signs informing the public of the status of ownership. No signs shall materially <br />adversely affect the Conservation Values of the Property. <br /> <br />D. Section 3.6 of the Conservation Easement is amended to read as follows: <br /> <br /> 3.6 The construction, reconstruction or replacement of any building or <br />other structure or improvement is prohibited, (i) except those existing on the date of this <br />Amendment as referenced in the Baseline Inventory (as hereafter defined), so long as <br />there is no material change to the use, location, appearance or size of such building, <br />structure or improvement; (ii) except for structures permitted under this Easement, which <br />will' not substantially diminish or impair the Conservation Values of the Property; and <br />(iii) except for structures permitted under the Approved Land Management Plan. <br /> <br />E. Section 3,9 of the Conservation Easement is amended to read as follows: <br /> <br /> 3.9 Any division or subdivision of title to the Property, whether by <br />physical or legal process, is prohibited except that this Section 3.9 shall not be deemed to <br />prohib!t the conveyance of right-of-way for the construction 0f Dillon Road or 96th Street, <br />or both as permitted under Section 3.10, below. <br /> <br />F. Section 3.10 of the Conservation Easement is amended to read as follows: <br /> <br /> 3.10 The paving or covering with concrete, asphalt, or any other paving <br />material, of any part of the Property or the construction of any road or trail on the <br />Property (collectively referred to as "Paving") is prohibited, except that this Section 3.10 <br />shall not be deemed to prohibit the conveyance of right-of-way for or construction of <br />Dillon Road or 96th Street, or both, and except further, this Section shall not be deemed to <br />prohibit the construction of trails with the written permission of Grantee and the Board. <br />Grantee and the Board shall give permission for trail construction within a reasonable <br />time, unless Grantee and the Board determine that the proposed paving or covering of the <br />soil, or the location of any trail, will substantially diminish or impair the Conservation <br />Values of the Property or is otherwise inconsistent with this Conservation Easement, as <br />amended, and such permission shall not be unreasonably withheld. <br /> <br /> G.
