Planning Commission Meeting Minutes May 13, 2010 Page 12 of 13 O'Connell, Pritchard, Brauneis, Sheets, Russell and Loo stated they favor the request. Loo moved and Sheets seconded a motion to approved Resolution No. 12, Series 2010 as presented by staff with the removal of Condition #1 regarding the liquor license modification. The conditions would be as follows: 1. The outdoor dining area shall not be used past closing time on any given day or, at the latest, past 12 AM. 2. This SRU is granted to the applicant only and may not be transferred to a different business at this location. 3. Russell discussed th der delivery of signs. O'Connell asked if the logical impact of a neon sign should be considered. She also discussed the ortance of the orientation of the sign as it relates to pedestrians and vehic traffic. Russ stated the strian vs. vehicle orientation would be determined by the goal being establi d within the code. Pritchard stated the need for flexibility, keeping communication open between the different interested parties, studying other communities regarding the pedestrian vs. vehicle concerns and what lighting would be appropriate for signs. Brauneis stated his concern with the nighttime pollution of signs with lighting. The following items are tentatively scheduled for June 10, 2010 ➢ LuckyPie, LLC — A special review use (SRU) request to allow for outside patio dining.
